AI Transparency & Limitations

1. Introduction

This AI Transparency & Limitation Addendum supplements the QBod Terms of Service and Privacy Policy. It provides detailed information about QBod's use of artificial intelligence technology, including third-party AI services, data processing, limitations, and your rights.

By consenting to AI features during signup or in Settings, you acknowledge that you have read and understood this Addendum and agree to the AI processing described herein.

2. AI Technology Overview

2.1 What AI Does

QBod uses artificial intelligence powered by Google Gemini to provide:

• Personalized AI coaching conversations
• Intelligent workout plan generation and adjustments
• Nutrition recommendations and meal planning
• Progress analysis and adaptive programming
• Natural language understanding of your fitness questions
• Context-aware guidance based on your goals and history

2.2 What AI Is NOT

AI coaching is NOT:

• Medical advice, diagnosis, or treatment
• A replacement for licensed healthcare professionals
• A certified personal trainer or registered dietitian
• Emergency medical assistance or crisis intervention
• 100% accurate, complete, or error-free

3. Third-Party AI Processing: Google Gemini

3.1 AI Service Provider

QBod uses Google Gemini to power AI coaching features. Google is a third-party service provider.

3.2 Data Sent to Google Gemini

When you use AI features, QBod sends the following information to Google Gemini:

• Your fitness goals and physical stats (height, weight, age, biological sex)
• Recent workout history and performance metrics
• Nutrition logs and dietary preferences
• Sleep, stress, and recovery data (if provided)
• Progress tracking and body composition measurements

Conversational Data:

• Questions you ask the AI coach
• Chat history for conversation context
• Feedback on AI recommendations

3.3 Data Protection Measures

Anonymization: QBod removes or anonymizes personal identifiers (name, email, precise location) before sending data to Google Gemini. Your data is processed with a unique identifier that cannot be traced back to your identity.

Contractual Protections:

• No Model Training: Google does NOT use your data to train AI models per Gemini API terms
• Data processed for immediate response only, not retained for training
• Standard Contractual Clauses for EU-approved contract terms
• All data transmission uses TLS 1.3 encryption

4. AI Limitations and Risks

4.1 Technical Limitations

AI-GENERATED CONTENT:

• May contain errors: Factual inaccuracies, outdated information, or incorrect calculations
• May be incomplete: Missing important details or considerations
• Is non-deterministic: Same input may produce different outputs at different times
• May reflect biases: Training data may contain demographic, cultural, or other biases
• Is probabilistic: Generated based on statistical patterns, not verified facts
• Lacks human oversight: Generated automatically without expert review

4.2 Health and Safety Risks

BECAUSE AI RECOMMENDATIONS MAY CONTAIN ERRORS, YOU MUST:

• Verify with professionals: Consult healthcare providers before acting on AI advice
• Use critical judgment: Evaluate AI recommendations for reasonableness and safety
• Monitor your body: Stop exercising immediately if you experience pain or discomfort
• Report errors: Notify QBod of any dangerous or incorrect AI recommendations

5. Your Rights and Choices

5.1 Opt-In Consent (Required)

AI features require explicit consent:

• During signup, you must check the "I consent to AI features" box
• Without AI consent, AI coaching and AI-generated workouts are unavailable
• Core tracking features remain available without AI consent

5.2 Withdrawal of Consent

You may withdraw AI consent at any time:

• Navigate to Settings > AI Features
• Toggle AI features OFF
• Effect: Stops new data from being sent to Google Gemini; preserves existing data
• Re-enable: You can turn AI features back ON at any time

5.3 GDPR Rights (EU Residents)

If you are located in the European Union, you have additional rights:

• Right to Access: Request copy of data sent to Google Gemini for your account
• Right to Rectification: Correct inaccurate data
• Right to Erasure: Request deletion of AI processing data
• Right to Restrict Processing: Limit AI processing temporarily
• Right to Object: Object to AI processing based on legitimate interests
• Right to Data Portability: Receive AI conversation data in portable format
• Right to Lodge Complaint: File complaints with your data protection authority

6. GDPR Article 22 Compliance

6.1 Automated Decision-Making

QBod uses AI to make automated recommendations about:

• Workout programming and exercise selection

• Progress assessments and plan adjustments

These recommendations do NOT have legal effects or similarly significantly affect you (e.g., no credit decisions, no employment decisions, no healthcare diagnoses).

6.2 Your Right to Human Review

Under GDPR Article 22, you have the right to:

• Request human review of AI decisions that significantly affect you
• Express your point of view regarding AI recommendations
• Contest AI decisions and request explanations

6.3 No Solely Automated Decisions

QBod's AI provides recommendations only. YOU make all final decisions about:

• Whether to follow AI workout recommendations

AI does not make binding decisions on your behalf.

7. Data Retention

7.1 QBod Retention

• AI Coaching Conversations: Retained while your account is active to provide conversation history; deleted within 30 days of account deletion
• AI-Generated Plans: Retained as part of your fitness history; deleted within 30 days of account deletion
• AI Processing Logs: Technical logs retained for 90 days for service improvement; deleted automatically after 90 days

7.2 Google Gemini Retention

Data processed for immediate response only, not retained for training or analysis per Gemini API terms.

8. Transparency and Accountability

8.1 AI Model Information

• Model: Google Gemini 2.5 Flash (as of January 2025)
• Type: Large Language Model (LLM)
• Training Data: General internet data (not QBod user data)
• Update Frequency: Google updates models periodically; QBod updates integrations as needed

8.2 Incident Reporting

If AI processing causes a data breach or security incident:

• QBod will notify affected users within 72 hours (GDPR requirement)
• Notifications include incident description, data affected, and remediation steps
