These terms are an agreement between you and QBod LLC, a Texas company ("QBod", "we"). They cover the QBod app, website and coaching (the "Service"). Our Privacy Policy, Medical Disclaimer and AI Transparency page explain more and form part of these terms. QBod is available in the United States. Sections marked Australia apply to members in Australia once QBod is available there.
New members accept these terms when they sign up.
Your rights under consumer law come first
If you live in Australia, our Service comes with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure with the service, you are entitled to cancel your contract and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage.
If you live in the United States, your state's consumer laws also apply. Nothing in these terms takes away a right that the law says we cannot take away. Where any sentence below seems to, it doesn't apply to you to that extent.
1. Who can use QBod
You must be 18 or over, wherever you live. You need an account. Keep your sign-in private and tell us at support@qbod.fit if you think someone else has used it. You can use a nickname; you don't have to give your legal name.
2. What QBod is, and isn't
QBod gives you nutrition targets, training plans, logging tools and an AI coach (Coach Q). It is a general fitness and wellness tool.
QBod is not a medical service. It doesn't diagnose, treat or monitor any disease, and it is not a doctor, dietitian, psychologist or personal trainer. It can't help in an emergency. Read the Medical Disclaimer before you start.
Coach Q uses AI from providers based in the United States. AI replies are written by software, aren't checked by a person first, and can be wrong. They are not medical advice. Use your own judgement and ask a health professional about anything that matters for your health.
QBod is an AI-powered app and can't work without AI processing of the data you give it. Using QBod means agreeing to that processing, as our Privacy Policy explains. If you don't want it, you can stop by deleting your account.
3. Your subscription
QBod has one paid plan with everything included, billed monthly or yearly.
You buy it through the Apple App Store or Google Play. The store charges you, in your local currency, including any tax.
Prices today:
| Monthly | Yearly | |
|---|---|---|
| United States | US$9.99 | US$59.99 |
| Australia (coming soon) | Shown in the store in Australian dollars | Shown in the store in Australian dollars |
The store shows you the exact price before you pay. If the store's price differs from this page, the store's price is what you pay.
- Free trial. New subscribers may get a free trial. The store shows its length before you start. You won't be charged if you cancel at least 24 hours before the trial ends.
- Renewal. Your plan renews automatically at the end of each month or year unless you cancel at least 24 hours before it renews.
- Price changes. We'll tell you at least 30 days before a price change affects you, and Apple or Google will ask you as its rules require. You can cancel before it applies. A price increase applies only from your next renewal: a month or year you've already paid for keeps its price until it ends. The store may ask you to accept the new price before it applies.
4. Cancelling
Cancel any time in the store you bought from:
- iPhone: Settings > your name > Subscriptions > QBod > Cancel Subscription.
- Android: Google Play > profile icon > Payments & subscriptions > Subscriptions > QBod > Cancel subscription.
You keep access until the end of the period you've paid for. Deleting your QBod account does not cancel your subscription. Cancel in the store first.
5. Refunds
Apple and Google handle payments, so a refund request normally starts with them (see our Refunds page for the steps). You can also email us at support@qbod.fit and we'll help.
If you're in Australia and the store turns you down, contact us. If QBod has had a major failure, we will give you the remedy the Australian Consumer Law requires, whoever took your payment.
6. Your content
What you log, write and upload stays yours. You let us store, copy and process it only to run the Service for you, including sending it to the companies listed in our Privacy Policy. We may use combined statistics that don't identify you to improve QBod.
Don't upload anything illegal, anything that infringes someone else's rights, or anything harmful. Don't post intimate images of anyone without their consent. If someone has, email support@qbod.fit with the subject "NCII Removal Request" and we will remove it within 48 hours of a valid request.
7. Fair use
Don't copy, resell, reverse-engineer or scrape QBod, misuse the coach, or try to get around security or usage limits.
8. Changes to QBod and to these terms
We improve QBod over time, so features can change. If we remove something important you've paid for, we'll tell you first and you can cancel.
When we change these terms we publish a new version with a new number and date, and keep every version from 4.0 onward at qbod.fit/legal/versions. A new version doesn't apply to you just because we posted it. If a change matters to you, we tell you in the app or by email before it applies. If you'd rather not accept, you can cancel your subscription in the store, and ask for a copy of your data or delete your account; you keep access until the end of the period you've paid for.
9. Ending your account
You can delete your account any time in Profile > Delete Account (see our Privacy Policy for what happens).
We may suspend or close an account that breaks these terms, puts others at risk, or where the law requires it. Unless there is a safety or legal reason not to, we'll tell you why first and give you a chance to fix it. If we close your account without a good reason, or stop offering QBod, we will refund the unused part of your paid period.
10. Our responsibility
We provide QBod with care and skill. We don't promise you'll reach a particular weight or fitness result, and we aren't responsible for harm caused by ignoring the Medical Disclaimer or a health professional's advice.
To the extent the law allows, our total responsibility to you for any claim is limited to the greater of what you paid us in the 12 months before the claim or US$100. This limit doesn't apply to anything the law doesn't let us limit, including the Australian Consumer Law guarantees, or to harm caused by our fraud or negligence where the law forbids a limit.
11. Disputes
Please email support@qbod.fit first. Most problems are fixed that way.
- United States: Texas law applies.
- Australia: the law of your state or territory applies, and you can bring a claim in your local courts or tribunals, or go to your state's consumer affairs body.
12. Other terms
If part of these terms can't be enforced, the rest still applies. We can transfer this agreement to a company that takes over QBod; your rights don't shrink when we do. These terms and the documents they mention are the whole agreement.
